Terms of Service
Who these terms are between
PawAndMe (pawandmeai.com) is operated from Hong Kong by the business registered with our payment provider, referred to here as “we”. By using the site you agree to these terms. You must be at least 16 years old to use the site and at least 18, or the age of majority where you live, to buy credits or a plan.
What the service does
You upload one photo of a person and one of a pet (or only a pet), choose a scene, and we create a new image with third-party AI image models. Results vary: AI images are not photographs, likeness is close but not guaranteed, and a photo that fails to generate is never charged.
Your photos and your responsibilities
- You must own the photos you upload or have permission to use them, and every person pictured must have agreed to this AI edit.
- Do not upload photos of anyone under 18, anyone who has not agreed, public figures, or anything sexual, violent or unlawful. Our pre-check blocks these and repeated attempts close the account.
- You keep the rights to your uploads. For the images we create you get a personal, worldwide licence to use, print and share them. Commercial use (selling the images, using them in advertising) needs a plan; write to us.
- We may use anonymised, non-identifying statistics about usage to improve the service. We do not use your photos to train models and we do not sell them.
Credits, packs and plans
- Photos cost credits: 1 credit at 1K, 2 at 2K, 4 at 4K. Credit packs (30 for $9.9, 100 for $22.4, 400 for $59.9) are one payment and never expire.
- Plans (Basic: $9.9 a month or $99 a year; Plus: $19.9 a month or $199 a year; Pro: $39.9 a month or $399 a year) are subscriptions that add credits every period. Plan credits do not roll over; they reset at each renewal. Prices exclude tax.
- Plans renew automatically at the end of each period until you cancel. Before a yearly renewal we email a reminder at least 30 days ahead. Cancel at any time from the billing portal in your account; cancellation takes effect at the end of the period you paid for and you keep the plan until then.
- Downgrades take effect at the next renewal. Upgrades take effect immediately and you are charged the difference for the remaining days.
- New accounts receive 2 free credits for 1K photos that carry a watermark. Any purchase removes the watermark from those photos and from every photo after.
- If we change a price, the new price applies only to new purchases. Payments are processed by Stripe; we never see your card number.
No refunds
Payments for credits and plans are not refundable, in whole or in part, including unused credits and unused time after you cancel. Credits and photos are digital goods delivered immediately. At checkout you tick a box confirming that you want access to start at once and that you waive any statutory right of withdrawal (for example the 14-day right under EU and UK consumer law). Without that consent the purchase cannot be completed. The refund policy lists the exceptions we honour: duplicate charges, a service that was unavailable, retired paid features, and any case where the law requires a refund.
Your account and your data
- Sign-in is by email link. You are responsible for keeping access to that mailbox.
- Uploaded photos are deleted as soon as your image is made (24 hours at most). Finished photos stay in your account for as long as it exists once you have bought anything; on a free account they are deleted after 7 days.
- You can delete any photo, or your whole account, at any time from Settings. Deleting the account removes everything, including unused credits.
- Details are in the privacy policy.
Disputes and chargebacks
If a payment is disputed with your bank, the account’s credits and plan are suspended while the dispute is open. An account with two chargebacks is permanently refused for new purchases. Please write to us first; billing mistakes are fixed quickly.
Availability and changes
We may change scenes, models or features, and the images a given scene produces will change as the underlying models improve. If we retire a paid feature you rely on, you may cancel and the no-refund rule does not apply to time you cannot use.
Limitation of liability
To the extent the law allows, our total liability for any claim connected to the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect losses. Nothing here limits liability that cannot be limited by law, or the rights you have as a consumer under mandatory law where you live.
Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules, and the courts of Hong Kong have jurisdiction over disputes. If you are a consumer in the EU, UK or another jurisdiction with mandatory consumer protection, you also keep the protection of the law where you live and may bring claims in your local courts.
Changes to these terms
Material changes are announced on this page with a new date and, for subscribers, by email at least 14 days before they take effect.
